ONLINE STORE TERMS AND CONDITIONS
1. General provisions
The online store operating at optiflex.pl is run by OPTIFLEX Beata Kudas, ul. Juliusza Słowackiego 64, 32-400 Myślenice, NIP: 6811040924, REGON: 356741485.
The store sells power hydraulics products: hoses, machines, crimping machines, connectors, etc.
The terms and conditions define the rules for using the store, placing orders, payments, delivery, withdrawal from the contract, and the rules for complaints.
The store’s customers may be both consumers (natural persons performing legal transactions not directly related to their business activity) and companies.
2. Definitions
Customer – a natural person, legal person, or organizational unit without legal personality who makes purchases in the store.
Consumer – a Customer who is a natural person making a purchase not directly related to their business activity.
Product – a movable item offered in the store.
Sales contract – a contract for the sale of a Product concluded between the Store and the Customer remotely via the website.
3. Placing orders
The Customer selects a product, adds it to the basket, goes through the ordering process, provides the necessary details for fulfillment, and selects the payment and delivery method.
The Store confirms the acceptance of the order electronically (e.g., by email) – this confirmation contains information about the order, the total price, the delivery method, and the expected delivery date.
The sales contract is concluded when the Customer receives confirmation of acceptance of the order for fulfillment.
4. Prices and payments
Product prices are given in Polish zlotys (PLN) and include VAT, unless otherwise indicated.
The Store may offer various forms of payment, e.g., bank transfer, card payment, online payment systems. Payment details are available when placing an order.
If payment requires a prior transfer, the payment terms are specified in the payment information when ordering.
5. Delivery
The goods are sent to the address provided by the Customer when placing the order.
The delivery costs are borne by the Customer, unless the Store offers free delivery above a certain amount.
The delivery date is specified when placing the order or in the order confirmation.
6. Right to withdraw from the contract (for Consumers)
The Consumer has the right to withdraw from the contract without giving any reason within 14 calendar days from the date of receipt of the shipment.
To exercise the right of withdrawal, the Consumer must inform the Store (e.g., by e-mail or withdrawal form) of their decision.
The Consumer should return the product immediately, no later than 14 days from the date on which they notified the Store of their withdrawal.
The costs of returning the goods shall be borne by the Consumer, unless the Store has agreed to cover them.
The Store shall refund all payments received from the Consumer, including delivery costs (except for additional costs resulting from the Consumer’s choice of a delivery method other than the cheapest standard delivery method), immediately, no later than 14 days from the date of receipt of the information about the withdrawal.
7. Complaints and warranty
The products offered in the Store comply with applicable Polish standards.
The Customer has the right to file a complaint if the product is defective. Complaints should be sent in writing or by e-mail to the Store’s address, describing the defect and attaching photos, if possible.
The Store undertakes to consider the complaint within 14 days of its receipt. If additional analysis is required, the time may be extended with prior notification to the Customer.
8. Liability
The Store is not liable for non-performance or improper performance of the contract if this is caused by force majeure or the Customer.
The Store is not liable for damage resulting from improper use of the products by the Customer or use contrary to their intended purpose.
9. Intellectual property
All copyrights to the content posted on the website (texts, photos, graphics) belong to the Store or entities that have granted the Store a license.
Copying, distributing, or using the materials without permission is prohibited.
10. Final provisions
The Store reserves the right to change the terms and conditions. Changes come into force after they are published on the Store’s website, unless the Store decides otherwise.
In matters not covered by these Terms and Conditions, the relevant provisions of Polish law shall apply, including: the Civil Code, the Consumer Rights Act, the Act on the provision of electronic services, and other applicable regulations.
In the event of a dispute, a Customer who is a Consumer may use mediation or file a complaint with the appropriate authority (e.g., the Office of Competition and Consumer Protection or the Consumer Ombudsman).
